These License Terms are an agreement between SuperEx (or your local SuperEx affiliate) and you. Please read carefully. These Terms apply to the above software, including the media on which you receive the software, if any. This term also applies to any SuperEx-provided software for this software.

Except to the extent that other terms are attached; and to the extent that other terms are attached, such other terms shall be observed.
By using the Software, you accept these Terms. If you do not accept these Terms, do not use the Software.
If you comply with the terms of this license, you will have the following permanent rights.
1. Installation and use of rights.
a. Installation and Use. You may install and use one copy of the Software on your device.
b. Third Party Programs. The Software may contain third party programs that SuperEx (and not third parties) licenses to you under the terms of this Agreement. The statements of third party programs, if any, are provided for informational purposes only.
2. INTERNET-based services.
SuperEx provides Internet-based services with the Software. Such services may be changed or cancelled at any time. The Software connects to the Services and computer systems via the Internet (including third party Internet sites); by using the Software, you consent to the transfer of standard device information (including, but not limited to, technical information about your device, system and application software, and peripheral devices) for use of the Internet-based or wireless services. If additional terms are provided in connection with the use of the Software to access the services you use, they are subject to these Terms. You may not use these services in any manner that could harm these services or interfere with others' use of these services. You may not use these services to attempt to gain unauthorized access to any service, data, account or network by any means.
3. Scope of the license.
The Software is licensed, not sold, for use only. This Agreement grants you only certain rights to use the Software, and SuperEx reserves all other rights. Unless applicable law grants you rights beyond this limitation, you may use the Software only to the extent expressly permitted by this Agreement. To do so, you must comply with any technical limitations in the Software that permit you to use the Software only in a particular manner.
You must not
- Bypass any technical limitations in the Software.
- Reverse engineer, reverse compile or disassemble the Software; notwithstanding this limitation, this limitation shall not apply if the applicable law expressly permits the foregoing activities.
- Make more copies of the Software than are permitted under this Agreement or under applicable law, notwithstanding this limitation.
- Distribute the Software for copying by others.
- Rent, lease or lend the Software.
- Transfer the Software or this Agreement to any third party.
- Use the Software to provide commercial software hosting services.
4. Backup copy.
You can make a backup copy of the software. This copy can only be used to reinstall the software.
5. Documentation.
All users with legal access to your computer or internal network may make copies of this documentation for internal reference purposes only.
6. Export Restrictions.
The Software is subject to Canadian export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the Software. These laws include various restrictions on destination, end user and end use.
7. Support Services.
Because the Software is provided "as is", we may not provide support services for it.
8. Entire Agreement.
This Agreement, together with the terms of the supplemental programs, updates, Internet-based services, and support services used by you, constitute the entire agreement for the Software and support services.
9. Legal effect.
This Agreement sets forth certain legal rights. You may have other rights depending on the laws of your country. You may also have rights related to the seller of your Software. If the laws of your country do not allow this Agreement to change your rights under the laws of your country, then this Agreement will not change your rights under the laws of your country.
10. Disclaimer of Warranties.
The software is licensed on an "as is" basis. SuperEx makes no express warranties, guarantees, or conditions with respect to the Software. You may have other consumer rights or statutory protections under your local laws that cannot be changed by this Agreement. To the extent permitted by your local law, SuperEx excludes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation and exclusion of liability for damages.
You may only receive a refund from Microsoft and its suppliers for direct damages up to the amount of the refund. you may not receive a refund for any other damages, including consequential damages, lost profits, special damages, indirect damages, or incidental damages.
This limitation applies to.
- Anything related to software, services, content (including code) or third party programs on third party Internet sites; and
- Claims arising out of breach of contract, breach of warranty, guarantee or condition, strict liability, negligence or other tort, to the extent permitted by applicable law.
This limitation applies even if superex knew or should have known of the possibility of damages. because your country may not allow the exclusion or limitation of liability for incidental, consequential, or other damages, the above limitation or exclusion may not apply to you.
