By participating in SUPEREX's Copy Trading Service (as defined below), you confirm that you have read, understood, and accepted all the terms and conditions outlined in these Copy Trading Service Terms of Use (hereinafter referred to as the "Terms") and agree to be bound by them. If you do not fully understand or accept these Terms, please do not participate.
2. Overview of Copy Trading
2.1 Copy Trading Service
Copy Trading provides you (as a "Copy Trader") with the opportunity to interact with other traders and replicate their investment portfolios. You can make investment decisions regarding crypto assets based on the information provided by Lead Traders (who may be anonymous or unidentifiable) (e.g., details of their trades executed on the platform, collectively referred to as the "Copy Trading Service" or "Copy Trading").
Copy Trading also allows you (as a "Lead Trader") to interact with other traders and provide trade signals for Copy Traders to follow.
Please note that Copy Trading does not provide personalized investment advice. All information is for reference only, and you should make independent decisions and assume corresponding risks.
2.2 Suitability Assessment
SUPEREX reserves the right to evaluate your knowledge, experience, and adaptability to determine whether Copy Trading is suitable for you. This assessment will be based on the information and documents you provide, which you may update at any time. If you provide false information during the assessment, resulting in financial loss, SUPEREX shall bear no responsibility. You must provide truthful and accurate information to ensure the validity of the assessment.
2.3 Trade Execution
Copy Trading only provides an order replication service and does not guarantee that copied orders will have the same opening/closing prices, timing, or profit and loss ratios. You understand that market conditions, liquidity changes, and system command delays may affect trade outcomes. Please note that market volatility may cause significant differences between your actual and expected trading results.
2.4 Monitoring and Management
SUPEREX continuously monitors user performance and reserves the right to take the following actions at its sole discretion:
(i) Open and close accounts;
(ii) Include or exclude Lead Traders and Copy Traders;
(iii) Suspend copy trading permissions for any account;
(iv) Cancel or reject any order for security reasons;
(v) Terminate relationships with users.
SUPEREX reserves the right to modify the service terms at any time to accommodate market changes.
3. Representations and Warranties
3.1 User Representations and Warranties
By using the Copy Trading Service, you represent and warrant that:
- You have the legal capacity to enter into these Terms;
- You have obtained all necessary consents and authorizations to legally participate in Copy Trading;
- The information you provide is truthful, accurate, and complete;
- You will keep your account information confidential and assume responsibility for any consequences of information leakage;
- You will not use another person’s information, and if the information you provide is inaccurate, illegal, or invalid, SUPEREX reserves the right to prohibit you from using the service;
- You understand and agree that you may be subject to KYC (Know Your Customer) verification, including screening for politically exposed persons and sanctions lists;
- You agree to keep your personal information updated during your use of the service and promptly notify SUPEREX of any changes;
- You acknowledge and agree to report any errors to the copy trading platform within 72 hours of trade execution;
- You will not upload or transmit any malicious code or manipulate any aspect of the Copy Trading platform in any way;
- You agree to publish only information that complies with relevant laws and regulations and refrain from maliciously posting or spreading illegal or unethical content, including but not limited to text, images, audio, and video;
- The funds you invest through the Copy Trading Service must not originate from illegal activities, including but not limited to drug trafficking and terrorism.
3.2 Breach of Terms
If you violate any of the representations under these Terms, SUPEREX may close your account or cancel your orders, and you will be solely responsible for any resulting losses. You shall bear full liability for any claims, losses, or expenses arising from a violation of these Terms.
4. Risk Assumption
4.1 Volatility of Crypto Assets
The prices of crypto assets are highly volatile, and you may incur rapid losses. Therefore, you should not invest funds that you cannot afford to lose. You must fully understand the risks of investing and make decisions based on your financial situation, level of experience, and risk tolerance. If necessary, you should seek advice from an independent financial advisor.
4.2 Trading Risks
Copy trading may be unavailable due to technical failures, network issues, or other unforeseen events. SUPEREX is not responsible for any losses resulting from such issues. You should be aware of the following risks:
- Malfunctions of computers or mobile devices;
- Unstable or interrupted network connections;
- Malicious software attacks;
- Incompatibility between devices and the platform;
- Service interruptions due to force majeure events;
- Insufficient market liquidity, which may prevent trades from executing at expected prices.
4.3 Automated Trade Execution
Copy trading requires automated trade execution, which means trades may be opened and closed without your direct involvement. You acknowledge and accept this risk and agree to bear all consequences resulting from the automatic execution of trades.
4.4 Risks of Following Inexperienced Traders
Following or copying the decisions of inexperienced or unprofessional traders carries inherent risks. SUPEREX makes no representations regarding the expertise, skills, or diligence of the traders you choose to follow or copy.
4.5 Legal Obligations
You are responsible for determining whether any laws, regulations, or tax obligations apply to you based on your activities. You must comply with and fulfill these obligations, including reporting and paying the correct taxes to the appropriate tax authorities if required. In particular, you should verify whether your activities require any licenses or registrations, such as registering as a self-employed individual or a virtual asset service provider.
4.6 Limitation of Liability
You agree that you are solely responsible for any and all losses resulting from the automatic operation of the copy trading service. As a user of the copy trading service, you acknowledge that you assume all risks associated with this service, including but not limited to those outlined in these Terms.
5. User Content
5.1 Content Responsibility
You are solely responsible for the content you post on the platform ("Your Content"). You grant SUPEREX a global, irrevocable, royalty-free license to use, store, and distribute your content. You agree that SUPEREX may use your content to provide services.
5.2 Content Compliance
You must ensure that your content complies with applicable laws and regulations. You may not post any illegal, malicious, or inappropriate information. SUPEREX reserves the right to remove any content that violates these Terms and to pursue legal action if necessary.
5.3 Copyright and Liability
You are responsible for any damages caused by infringement or other violations of copyrights, trademarks, or proprietary rights of any individual or entity. You acknowledge and agree that SUPEREX may delete content related to such violations and take all legally appropriate measures.
5.4 Restrictions on Content Posting
You may not provide investment advice, portfolio management services, or any other similar services. You are also prohibited from posting content that is illegal, violent, racist, abusive, offensive, defamatory, harassing, sexually explicit, obscene, or hateful. If you violate these restrictions, SUPEREX reserves the right to take appropriate action.
5.5 Cooperation with Law Enforcement
If requested by law enforcement or government agencies, SUPEREX may share your content to assist in investigations of violations.
5.6 Accuracy of Information
SUPEREX may publish news, charts, links to other websites, newsletters, or third-party information. We do not guarantee the accuracy or reliability of such information, and under no circumstances should it be considered investment advice. You assume all risks when using this information for your investment decisions.
6. Account Information and Transaction Records
6.1 Account History
You can view your account history on the platform. Please carefully review all transactions and promptly notify SUPEREX if you detect any unauthorized transactions. The maximum time frame for reporting such issues is 14 days. You should regularly review your account activity to ensure the accuracy of all transactions.
6.2 Correction of Transaction Records
SUPEREX reserves the right to correct any errors in account history at any time and may revoke any transactions if necessary. If an obvious error is detected, SUPEREX has the right to make adjustments based on reasonable judgment.
6.3 Information Sharing
In accordance with applicable laws, we may be required to share information regarding your account and platform usage with third parties. You acknowledge and agree that we have the right to disclose such information when necessary.
7. Technical Disclaimer
7.1 Service Interruptions
SUPEREX may temporarily suspend services for maintenance. We do not guarantee specific transaction processing times. You should understand that delays or service interruptions may impact your investment results. SUPEREX is not responsible for any losses incurred due to maintenance or other technical issues.
7.2 Accuracy of Information
Although SUPEREX makes reasonable efforts to update information related to the copy trading service, we make no express or implied representations, warranties, or guarantees that the content on the platform (including information related to SUPEREX services) is accurate, complete, or up to date. You are responsible for evaluating the validity of the information provided.
7.3 Hardware and Network Responsibility
You are responsible for ensuring access to the data network required to use SUPEREX services and for maintaining a compatible device and network connection. SUPEREX does not guarantee that the service will operate properly on any specific hardware or device.
